Re:      Confirmation of Access to Mental Health and Substance Use Disorder Treatment, and Provider Network Adequacy under Public Act 102-0144

This notice confirms that the Department is in compliance with access for treatment of mental health and substance use disorders, and provider network adequacy as required by Public Act 102-0144.

The Act amends the Public Aid Code to ensure that beneficiaries have timely and proximate access to treatment for mental, emotional, nervous, or substance use disorders or conditions in accordance with the provisions of paragraph (4) of subsection (a) of Section 370c of the Illinois Insurance Code. It also amends the Public Aid Code to ensure Medicaid managed care plans meet each of the requirements under subsection (d-5) of Section 10 of the Network Adequacy and Transparency Act.

The provisions of Public Act 102-0144 are already generally required of Medicaid managed care plans in their contracts with the State for all network adequacy, including mental, emotional, nervous, or substance use disorders or conditions.
